Assigned to the custody of his mother and his uncle Ichabod Bliss following his father's death, he subsequently chose his uncle Samuel Bliss as his guardian through his minority.4,2,5

His will, dated 15 Oct 1794 at Half Moon, New York, the testator being "very sick," and proved 12 Feb 1795, made "my wife Sarah, daughter of John Bagg, deceased, of West Springfield, Massachusetts," and Silas Hamilton executrix and executor respectively, and also guardians for "my two sons Joel and Aaron Brooks during their minority." He left sixteen pounds New York currency to be delivered to son Levi in New England, to be in turn equally divided among his children in New England. His sons Joel and Aaron were "to find a comfortable dwelling house and sufficient quantity of firewood for their mother during her life." Also mentioned were daughters Sarah, Clairey and Esther, and the first two male heirs (Chester and Israel) of his daughters Sarah and Clairey that should arrive at the age of 21.2,8
